Oliver Patrell et al. v. Town of Old Lyme Zoning Commission et al.
MEMORANDUM OF DECISION RE ISSUE OF AGGRIEVEMENT
This is an appeal by plaintiff trustees from a decision of the defendant, Zoning Commission of the Town of Old Lyme, granting approval of a site development plan and special permit in favor of defendant Barbara Guido.
The matter was reached for trial on April 26, 2011, at which time the action was dismissed for failure to establish aggrievement.
On April 29, 2011, plaintiff moved to reargue. This motion was denied by the court on May 13, 2011.
The decision to dismiss is hereby vacated and the court will reconsider the question of aggrievement on the record and matters in evidence.
