Devon Ellis v. Bar–One, LLC
MEMORANDUM OF DECISION
This is a one-count civil action wherein the plaintiff is seeking money damages from the defendant for injuries and losses he sustained when he was struck in the head by a bottle while a customer in a bar operated by the defendant on March 9, 2008 at 169 East Street in New Haven, Connecticut.
The plaintiff alleges he was a customer on the second floor of the defendant's bar when a fight occurred, not involving the plaintiff, and the plaintiff was injured due to the negligence of the defendant.
The defendant has been defaulted for failure to appear. This court heard this case as a hearing in damages on May 11, 2011.
As a result of being struck in the head with a large bottle the plaintiff suffered a loss of consciousness, a severe laceration over his left eye requiring 14 sutures, a contusion to the left shoulder, and severe shock to his entire nervous system. He suffered severe pain to his body and has been severely restricted in his way of life.
As a result of the injuries received by the plaintiff he has incurred expenses for ambulance services, and hospital services totaling $2,981.35.
As a result of being struck as aforesaid the plaintiff has a one-inch permanent scar on his head and continues to have severe headaches.
As a result of being struck the plaintiff has suffered economic damages of $2,981.35 and non-economic damages of $7,500.00. A judgment may enter in favor of the plaintiff and against the defendant in the sum of $10,481.35 plus costs.
