Carmen Martone, Executrix of the Estate of Sarah Martone v. Vincenzo Sullo (2011)

MEMORANDUM OF DECISION

This matter was tried before the court on March 11, 2011.   The court finds for the defendant based on Exhibit C prepared by him which shows that a number of payments were made by the defendant to his grandmother Sarah Martone while she was alive.   These payments were on account of $125,000 which the defendant owed for the purchase of the grandmother's house at 178 Thompson Street, East Haven, Connecticut.   According to Exhibit C a balance of $17,978.97 remained due and owing as of January '08.

The court called the parties back on May 3, 2011 in order to clarify a question it had concerning Exhibit C and learned that the $17,978.97 had been paid to the Estate by the defendant.

Therefore, judgment may enter in favor of the defendant.
