Wesley L. Norton v. Stephanie M. Norton
MEMORANDUM OF DECISION
The court, on its own accord, raised the question of whether Connecticut has jurisdiction over issues pertaining to the custody of the child at issue. Accordingly, the court held a hearing on April 26, 2011. The plaintiff was present and the defendant participated telephonically.
The court finds that the family lived in Florida from some time in 2005 until July 14, 2008 when the plaintiff husband relocated to Connecticut with the Navy. The wife and the child have never been to Connecticut. As such, Connecticut cannot be considered the child's home state as defined by Connecticut General Statutes § 46b–115k.
As such, the court is compelled to dismiss this case so that the parties may file an action appropriately in the state of Florida.
