Timothy V. Price et al. v. Appeal From Probate
MEMORANDUM OF DECISION
On March 28, 2011,the above captioned matter was assigned to this court for consideration of two pending motions filed by defendant Sterczala (# 104) Motion to dismiss and (# 111) Motion for Protective Order. The Motion to Dismiss was marked off and the Motion for Protective Order was to be taken on the papers.
Having considered the issues raised by the Complaint, the Motion to Dismiss, the Motion for Protective Order and the plaintiffs' objection thereto, the Court finds that the plaintiffs' objection to the relief sought in the Motion for Protective order and stay of discovery is sustained.
The Court will reserve decision on the relief sought in the Motion to Dismiss pending completion of discovery which is to be conducted without undue delay.
