MEMORANDUM OF DECISION ON MOTION FOR SUMMARY JUDGMENT

In view of circumstances surrounding the alleged fall, such as the presence of store employees, yet to be developed, there is a material question of fact as to whether a store employee made a statement indicating knowledge of the presence of liquid on the floor prior to the accident, thus satisfying the notice requirement.

Motion for Summary Judgment denied.
