Theodore VonRosenvinge IV v. Margo A. VonRosenvinge
SECOND AMENDED MEMORANDUM OF DECISION
On March 7, 2011, the plaintiff filed a motion pursuant to Practice Book § 11–11 of the Rules of Practice for reargument of the court's amended decision of February 16, 2011.
The Memorandum of Decision dated October 26, 2010 and Amended Memorandum of Decision dated February 16, 2011, are amended as follows:
1. The capital gains distributions ordered in Section D of the Memorandum of Decision dated October 26, 2010 refer to the periodic distributions from GeoDesign, Inc., and not to monies which the plaintiff would receive if he sold his stock in GeoDesign, Inc., or to any proceeds he would receive if the stockholders dissolved the corporation.
2. The following order in paragraph three of the Memorandum of Decision dated February 16, 2011 is hereby vacated: “In no event shall the plaintiff decrease the life insurance benefit to the defendant below his then-existing alimony obligation.”
3. All other relief sought by the plaintiff in his motion to reargue dated March 7, 2011 is hereby denied.
4. All other orders in the court's October 26, 2010 Memorandum and February 16, 2011 Amended Memorandum which are not modified herein shall remain in full force and effect.
