MEMORANDUM OF DECISION RE SUMMARY JUDGMENT (117.00)
The plaintiff has moved for summary judgment, and the court has applied the well accepted standards for adjudicating a summary judgment motion.
In her responses to a request for admissions the defendant has agreed that she was extended credit by the plaintiff's assignor under a credit installment agreement. She has also admitted she received statements of the account on a regular basis, made payments on the account, incurred late charges and interest and owes the plaintiff a balance of $8,542.20.
The defendant, who is represented by counsel, has filed no opposition to the summary judgment motion.
Based on the undisputed facts shown by the plaintiff the court finds there are no material facts in dispute, and the defendant's liability is established on an account stated theory to be in the amount of $8,542.20. See: General Petroleum Products, Inc. v. Merchants Trust Co., 115 Conn. 50, 56 (1932); Citibank (South Dakota) v. Manger, 105 Conn.App. 764 (2008); Credit One, LLC v. Head, 117 Conn.App. 92 (2009).
Judgment is entered in that amount, plus costs, with 6% postjudgment interest allowed.
