Gina Bohannon v. Duane Bohannon
MEMORANDUM OF DECISION
The plaintiff, whose birth name was Gina Coleman, and the defendant intermarried on November 18, 1994. There are two children issue of the marriage Aaliyah Bohannon, born on March 4, 1995 and Traevon B. Bohannon, born on September 3, 1996. In addition the plaintiff, two years ago, adopted a severely handicapped child, Devin Bohannon, born July 2, 2005. The State has contributed to the support of said child who has lived with the parties for 10 years. The court has the requisite jurisdiction.
The husband is 39 years old and the wife is 37 years old. The parties have been married approximately 17 years. The wife has multiple sclerosis that has been in remission. At one time her health was seriously impaired. She was blind for a period of time. She has, during most of the marriage, worked as a cosmetologist but she has no health insurance. Her medical expenses are significant and without insurance coverage could exceed $3,300 per month. There is no claim by the wife that the husband was anything but ideal except that he had at least two children out of wedlock that caused her to terminate the relationship.
The husband has, for a lengthy period of time, been employed in at least two employment positions and he has considerable debt. He finds no fault with his wife except that she is not a good housekeeper. He thinks that she should be generating more income.
Orders
The court has carefully considered the criteria set forth in §§ 46b-81 and 46b-82 of the Connecticut General Statutes as well as the gross and net income and assets and liabilities of the parties.
1. The marriage has broken down irretrievably and is dissolved.
2. The husband shall pay to the wife as alimony the sum of $150.00 per week. Said sum shall be paid to the wife until she becomes eligible and receives regular social security. In the event her health situation deteriorates or she obtains social security disability benefits, the issue of alimony shall be revisited. In the event that the wife dies or remarries alimony shall terminate. In the event she cohabits the issue of alimony shall be revisited.
3. The husband has a pension and QDRO that have a present value of approximately $79,300.00. Wife shall have thirty (30%) percent of said total. The parties shall share the cost of any expense incurred in said division.
4. The wife shall be the exclusive owner of the marital residence located at 93-A Yaremich Drive in Bridgeport and shall be responsible for any expenses related thereto.
5. Each party shall keep their respective motor vehicle as set forth on their affidavits.
6. Each party shall be responsible for their respective liabilities as set forth on their affidavits.
7. The husband shall, pursuant to COBRA, add his wife to his health insurance policy. The wife shall be responsible for 25% of any and all payments attributed to her and husband shall pay the other 75%.
8. The husband shall pay the sum of $235.00 per week as child support until each of the minor children shall attain the age of 18 or until their respective graduation. The court has not considered the issue of support as relates to Devin whose financial interest has been provided by other sources.
9. Any tax refund for the tax year 2010 shall be shared equally by the parties. Wife shall, commencing in the year 2011, take the children as dependants on her tax return and in the even years husband shall claim same.
10. Each party shall be responsible for their respective attorney fees.
