Jean Louis v. Melissa Gibbs
MEMORANDUM OF DECISION
This is a summary process action based on non-payment of rent. The case was tried on December 20, 2010 and January 5, 2011. The court has weighed all the evidence and assessed the credibility of the witnesses. Based on the evidence presented, the court makes the following findings regarding the respective claims and defenses.
The court finds that the plaintiff has proved, by a fair preponderance of the evidence, all the elements of the case. The court further finds that the defendant has not proved, by a fair preponderance of the evidence, the defense of retaliatory eviction under Connecticut General Statutes § 47a-20. Such a defense is applicable only in a summary process action based on lapse of time or right or privilege terminated.
Having considered the law and equity, the court enters judgment for the plaintiff for immediate possession. The full arrearage is $200 for the months of October, November, December and January.
