REISSUED MEMORANDUM OF DECISION MOTION FOR SUMMARY JUDGMENT # 129

The court granted the plaintiff's Motion to Reargue its granting of a summary judgment (Motion 129).   The court has considered the supplemental arguments submitted by the plaintiff in writing and in oral argument.   The court remains persuaded that its original analysis of the issues presented by the motion for summary judgment was sound.   The court reissues its earlier opinion that was filed on June 24, 2010 as docket number 129.50.
