MEMORANDUM OF DECISION RE MOTION TO RECONSIDER/REARGUE/CLARIFICATION
The Court responds to the defendant's motion as follows:
Paragraph 3a: This order is based on the face amount of the husband's employer provided insurance. No evidence provided for the cost, availability and ability to pay.
Paragraph 3b: The husband shall retain his ownership of the marital home at 140 Geraldine Drive and he shall be responsible for all expenses pertaining to the residence and shall hold the wife harmless therefrom.
Paragraph 3c: The Court did order the husband to transfer his interest therein to the wife. A quit-claim deed (prepared by him) is inherent in the order.
Paragraph 3d: (East Hartford) The Court declines to reconsider this order. The husband owned this property pre-marriage and the order takes that into account.
Paragraph 3d: (Tax Deductions) The Court clarifies its order to reflect the wife shall take Joseph as a tax deduction for 2010.
Paragraph 3e: There was insufficient credible evidence as to the value of these motor vehicles, boat, etc., but there was evidence that these items were not in the best shape, for example, the Barracuda is uninsured and not driveable, the boat hasn't been used in eight years, one car won't start. These items of property; while not without value, do not have sufficient value to affect the Court's decision.
Paragraph 3f: (Personal Property): The husband testified that the wife could take her personal items from the marital home as well as day care equipment. This did not appear to be an issue. In any event, the wife shall have the 2004 Jeep Liberty, her items of personal property, and her day care business items of personal property.
Paragraph 2g: (Operation of Day Care): The Court did not intend to make any orders regarding the operation of the day care business. The parties are free to make whatever arrangements they wish to.
