Kenneth Tullo et al. v. Connecticut Container Corp.
RULINGS ON REQUEST TO REVISE
(1) The court grants the request to revise as set forth in the Fourth Request to Revise. It is the court's understanding that plaintiff agrees to withdraw this language.
(2) Court will not order separate counts as to each plaintiff. But court will permit motion to strike and/or summary judgment to be pursued against claims of any individual plaintiff. Plaintiff does not object to this.
(3) As to CUTPA count, court concludes this is more properly addressed by means of a motion to strike.
(4) Court does not grant Third Request to Revise as this can be properly addressed through discovery. There are only six plaintiffs so a large class is not involved.
