Goldblatt & Rashiba, P.C. v. Jacqueline Caulfield
MEMORANDUM OF DECISION
In this action, the plaintiff seeks to recover attorney fees due as a result of the legal services provided by its deceased partner Richard Goldblatt in a family matter for the defendant Jacqueline Caulfield claiming a balance due of $14,532.00 based on an hourly rate of $295.00.
The defendant denies any balance is due and has filed a counterclaim claiming that Goldblatt failed to follow through with the several motions for contempt, agreed to settle the matter with counsel for the defendant's former husband without her permission and lost or otherwise disposed of her notes and other documentation which would support her claim against her former husband, all of which the court finds proven.
Under the circumstances of this case and the proof of both parties, the court enters judgment in favor of the plaintiff on the complaint and in favor of the defendant on the counter claim with no damages to either party and without costs to either party.
