Evelyn Torres v. Iris Montero
MEMORANDUM OF DECISION
This is an action by the plaintiff, Evelyn Torres, against her former tenant, the defendant, Iris Montero, for failure to pay the rent. A trial was held on October 12, 2010, in which the plaintiff was represented by counsel, the defendant was self-represented and both parties testified. The court finds that the testimony of the plaintiff was credible. The parties had a tenancy at will with the defendant agreeing to pay the plaintiff $900 a month, payable on the first of the month, with a $25 late fee if rent was not paid by the tenth of the month. The defendant does not dispute that she did not pay all of the rent and admits that she owes money to the plaintiff, however, she does dispute the amount claimed by the plaintiff. The court finds for the plaintiff and awards damages in the amount of $10,018 and costs. The court declines to award attorneys fees.
