Tibbets Keating & Butler v. Edward J. O'Hara
MEMORANDUM OF DECISION
Pursuant to Practice Book § 11-20A, this court orders that the documents provided to the court for purposes of the in camera review of the request for telephone numbers be sealed. In particular, the court is ordering the sealing of four separate documents dated June 11, 2010, September 8, 2010 and September 15, 2010 that specifically contain the telephone numbers of Attorney Butler and possibly the telephone numbers of clients that may not be listed and available to the public. Additionally, the court will order sealed the Schedule A attached to the subpoena for the telephone records.
The court scheduled this matter for notice of the court's determination of whether to seal the records on October 7, 2010. At that hearing, the court reviewed its orders concerning the in camera review of the documents to preserve the confidentiality of the attorney's private telephone numbers as well as any numbers that he may have called and are noted on the records. After a review of the records, the court noted that neither of the two numbers that the defendant represented to the court would be relevant to his defense were contained in the records. Therefore, in the interests of the attorney who does not wish to have his private numbers published to anyone who would have access to the court files as well as the concern about publishing private numbers of some clients, this court believes it is in the best interest to seal the four documents noted above.
