Clifford Haslam v. Marcia Haslam
MEMORANDUM OF DECISION
The parties as part of their marriage dissolution entered into an agreement dated January 23, 1990. The agreement provides that the plaintiff will pay the defendant $350.00 per week as non-modifiable alimony. It is agreed that at the time of hearing (9-27-10) on plaintiff's motion for contempt there is due and owing the sum of $12,290.00 in back alimony. The defendant has been credited with a small social security payment of $38.00 per month. The plaintiff claims that he simply cannot pay the amount due and owing. He has been remarried for some twenty years and his three antique motor vehicles having a value of at least $50,000 were placed in his current wife's name some time again. He has, as late as five months ago, transferred ownership of his real estate interest in Stratford having substantial equity to his current wife. He has real estate in LeMoine, Maine in his name having at least a $30,000 value. He claims to be retired but admits to working part-time. His former wife is struggling.
The court finds his contempt to be wilful and it is ordered that he pay the defendant the sum of $12,290.00 with attorney fees in the amount of $1,000.00 no later than November 12, 2010. He shall also be current on any arrearage since the date of the current hearing.
Plaintiff shall appear on November 18, 2010 at 9:15 a.m. for the imposition of sanctions.
