Mary Celone v. James Celone
RULINGS ON PENDENTE LITE MOTION FOR CONTRIBUTION (# 167) AND MOTION FOR CONTEMPT (# 168)
The court, after hearing the issues presented in the above entitled motions, hereby enters the following rulings:
As to Motion (# 167), the court orders the defendant to pay to the plaintiff reimbursement for the children's expenses as follows: $1,800 for Christina's piano lessons; $1,400 for Cynthia's dance lessons; and $650.00 toward Cynthia's food and expenses while she attended the Jaffre Ballet camp. The court declines to enter orders for contributions toward the cost of Math tutoring or for the Camp Explo for the reasons the father is a math teacher and will provide tutoring to the children, and the parties failed to reach an agreement regarding the child's attendance at the Camp Explo.
The court hereby denies the plaintiff's Motion for Contempt (# 168) and finds the plaintiff failed to prove the defendant willfully failed and refused to obey a court order pursuant to the Agreement of November 5, 2008, in that it provides that “each party shall be responsible for one-half of all agreed upon extracurricular activities of the minor child.” The plaintiff has failed to prove that the parties had agreed to all the activities and extra expenses for which she now seeks reimbursement.
