DECISION RE MOTION TO RECTIFY JUDGMENT

This plaintiff's motion dated August 4, 2010 seeks attorney fees in the captioned Amended Complaint dated February 12, 2010.

The Motion to Rectify is denied.

Plaintiff has failed to prove by a preponderance of the evidence that the defendant agreed to pay attorney fees if the plaintiff was successful in its underlying action, nor did it prove that attorney fees are permitted by statute in this action.

Judgment may enter accordingly.
