Barbara Lucci v. Anthony Lucci
MEMORANDUM OF DECISION
The defendant filed a motion to modify court ordered child support. An evidentiary hearing was held on August 10, 2010.
The defendant, who is an attorney and Certified Public Accountant, sought to have an order entered in February 2010 by Judge Turner further modified. Under statutory authority to modify a support order, the party seeking the modification must demonstrate that a substantial change in circumstances has taken place since the entry of the earlier modification. Borkowski v. Borkowski, 228 Conn. 729; Simms v. Simms, 283 Conn. 400, 494.
The court did not find the defendant to be a credible witness and did not sustain his burden of proof with respect to a substantial change in circumstances since Judge Turner's order some six months earlier.
The Motion to Articulate and Reargument are denied.
