MEMORANDUM OF DECISION de DEFENDANT'S MOTION FOR ATTORNEYS FEES POST-JUDGMENT (194)
The defendant seeks an allowance to defend the plaintiff's appeal of the court's decision dissolving their marriage after the appeal was concluded by the affirmation of the decision by the Appellate Court. This motion does not afford the plaintiff the opportunity to include the ruling on the present motion in his initial appeal. The defendant moved for attorneys fees to defend the appeal by motion dated March 3, 2008(175) but it was never heard. Had the allowance request been ruled upon when the appeal was pending either party could have sought redress of an adverse ruling. The defendant sought and obtained release of funds during the appeal. The defendant was not without funds while awaiting the appellate result. The court concludes the awards made in the judgment are generous and to require the defendant to pay her attorney will not undermine them. Turgeon v. Turgeon, 190 Conn. 269, 280-82. The motion is denied.
