Dolores Jackson v. Nateysha Pointdexter-Monk
MEMORANDUM OF DECISION
This is a civil action wherein the plaintiff, Dolores Jackson, is seeking money damages from the defendant, Nateysha Pointdexter-Monk, for injuries and losses sustained on July 13, 2009 when a porch railing that the plaintiff was leaning against collapsed, causing her to fall about five feet to the ground. The fall occurred at 377 Shelton Avenue, New Haven, Connecticut, which is property owned by the defendant. The plaintiff claims that the railing collapsed due to the negligence of the defendant in several respects.
The defendant has been defaulted for failure to appear. She is not in the military service. This court heard this case as a hearing in damages on July 14, 2010.
When the plaintiff fell she landed on her neck and shoulders. As a result of the fall the plaintiff suffered a cervical disc syndrome, cervicalgia, cervically related headaches, brachial neuritis, cervically related parastesia, neuropathic insomnia, thoracic sprain, thoracic pain, and thoracic myofacitis. She has incurred ambulance, medical, and hospital expenses totaling $7,730.89. The plaintiff is obligated to reimburse the insurance companies for payments made on these bills, and to pay the suppliers of the services for the portion of the expenses not paid by insurance.
As a result of the fall the plaintiff has suffered economic damages of $7,730.89 and non-economic damages of $15,000.00. A judgment may enter in favor of the plaintiff as against the defendant in the amount of $22,730.89, plus cost of $476.20.
