Robert J. Trez v. International Water Safety Foundation et al
MEMORANDUM OF DECISION RE RULING ON MOTION TO REARGUE AND FOR RECONSIDERATION (127.00)
The motion for reargument has been carefully considered, and it is denied. Contrary to the argument of defendants Case and P & C, this court did not hold that collateral estoppel did not apply because Case and P & C were not parties to the arbitration. Rather, it held that collateral estoppel was not available because there was not sufficient privity between Case and P & C on one hand, and the insurers on the other.
The other contentions in the motion are unpersuasive.
