John Knox v. Ida Jean Knox
MEMORANDUM OF DECISION ON PLAINTIFF'S MOTION FOR ATTORNEY FEES (# 148) and on DEFENDANT”S MOTION FOR CONTEMPT (# 155)
Following a hearing on the above motions at which the court heard testimony and reviewed exhibits of both parties, taking note of nine prior hearings in which the court observed the credibility and demeanor of both parties and acquired a thorough understanding of the dynamic of their conflict, following arguments and written submissions by each on the instant motions, and in light of controlling statutory and decisional authorities, it is hereby
ORDERED:
1. Plaintiff shall recover from defendant attorneys fees of $4,200 (in addition to $1,000 previously ordered and paid), plus home cleanup expenses totaling $608.56, plus $5,000 due him pursuant to the dissolution decree of July 17, 2007, for a total of $9,808.56.
2. Defendant's motion for contempt is denied.
3. The escrow agent holding the net proceeds of the parties' sale of realty shall be disbursed $9808.56 to plaintiff, and the remaining $12,978.46 to defendant.
4. This order encompasses all claims for fees through this date.
