Electrical Wholesalers, Inc. v. V.P. Electric, Inc. et al
MEMORANDUM OF DECISION RE ATTORNEYS FEES AND COSTS
After a court side trial on November 18, 19 and December 2, 3, 8 and 9, 2009, the court entered judgment for the plaintiff in the amount of $51,284.75. The plaintiff had entered into a purchasing credit agreement dated March 5, 2008 with the defendant V.P. Electric, Inc., which agreement provided that the defendant, Victor Pietrandrea, personally guaranteed the obligations of the account under the credit agreement and under said agreement the plaintiff would be entitled to service charges and reasonable attorneys fees in the event it was necessary to bring legal action to collect the debt.
By a hearing of even date herewith the court heard the parties. The court has examined the materials submitted and in addition has examined a very complete analysis of setting attorneys fees in a memorandum filed by Aurigemma, J. in Jacobsen v. Security Connecticut Life Insurance, No. X 03 CV 95-0493100-S Connecticut Superior Court, judicial district of New Britain, September 2, 1999.
Attorney Miller, counsel for the plaintiff, has submitted an affidavit and a very detailed time sheet which the court has examined in detail. The court finds the fees outlined in this affidavit and time sheet to be appropriate to the nature of the work conducted by Attorney Miller and to be reasonably necessary to effectively represent the plaintiff in this action and the hourly rate charged throughout is fair, reasonable and appropriate. The court therefore approves the total claimed legal fees of $43,640 (218.2 hours x $200 per hour) and the court approves the costs of $6,401.77 paid by counsel.
