MEMORANDUM OF DECISION RE MOTION FOR CONTEMPT # 176
The plaintiff, Carol Ann Watson, has filed a motion for contempt against the defendant, William Watson, for his alleged failure to comply with a post-judgment court order requiring him to pay mortgage foreclosure fees and expenses. Subsequent to the court's order, the defendant filed for federal bankruptcy protection pursuant to 11 U.S.C. § 301. The fees and expenses the plaintiff seeks to have the defendant pay are not related to alimony or support orders. Accordingly, the plaintiff's motion for contempt seeking to require the plaintiff to pay mortgage foreclosure fees and expenses is not actionable by the court at this time pursuant to the automatic stay provisions of 11 U.S.C. § 362. The plaintiff's motion for contempt is denied.
