MEMORANDUM OF DECISION RE DEFENDANT'S AMENDED MOTION FOR CONTEMPT POSTJUDGMENT DATED AUGUST 11, 2009 CODED 136
The court finds that the plaintiff has failed to make his alimony payments since April of 2009. The plaintiff has deferred compensation plans with a value of $388,116. The burden of proving inability to pay rests upon the obligor. The court finds that the plaintiff has failed to meet that burden. While the court could hold the plaintiff in contempt, the court is going to exercise its discretion and not hold him in contempt, however, the court is ordering that he pay counsel fees to counsel for the defendant in the amount of $2,000. The arrearage and the attorneys fees are to be paid within thirty (30) days from today's date.
