Michele Martini v. Anthony Martini, Jr.
MEMORANDUM RE ORDER FOR ARTICULATION
On January 6, 2010, the Appellate Court granted the defendant-appellant's motion for review of denial of articulation and ordered this court to articulate what it found the husband's net income to be, how it arrived at its determination of the husband's net income, and whether it deviated from the child support guidelines in issuing its pendente lite orders of alimony and child support.
On October 1, 2008, the plaintiff filed with this court a pendente lite motion seeking alimony, custody, child support and counsel fees (# 101.01, # 101.02, # 101.03, # 101.04). The matter was heard before the court on November 2, December 3 and December 10, 2008. This court issued a memorandum of decision dated December 22, 2008.
The court articulates as follows:
1. The court finds the defendant's net income is $1,440.00 per week;
2. The child support guidelines worksheet dated November 13, 2008, prepared on behalf of the plaintiff, shows a combined net weekly income of $1,440.00.
3. The defendant's gross cash income is $546.00 per week and his weekly gift income is $1,454.00 for a weekly gross income of $2,000.00;
4. The court found no deviation from the child support guidelines in issuing its pendente lite orders of alimony and child support.
