State of Connecticut v. Robert Bates
RULING ON DEFENDANT'S MOTION FOR ARTICULATION DATED MARCH 6, 2007
On March 6, 2007, the defendant, Robert Bates, filed a Motion for Articulation. The motion is granted and the articulation is as follows:
1. As to the denial of the defendant's motion for judgment of acquittal, the court considered the evidence presented in the light most favorable to the prosecution and the reasonable inferences drawn therefrom, and concluded that the cumulative effect of the evidence was sufficient to justify a finding of guilty by the jury as to each count in the defendant's motion.
2. As to the denial of the defendant's motion to suppress physical evidence, the court, having heard the evidence presented, found that there was a reasonable and articulable suspicion to stop the vehicle.
