Matthew James KING, Appellant, v. Charles DANIELS, NDOC Director; Brian Williams, NDOC Deputy Director; and William A. Gittere, Warden, Respondents.
ORDER OF AFFIRMANCE
Matthew James King appeals from an order of the district court dismissing a postconviction petition for a writ of habeas corpus filed on May 19, 2020. Seventh Judicial District Court, White Pine County; Steve L. Dobrescu, Judge.
In his petition, King argued he should be released from prison because COVID-19 creates an inherently dangerous situation in prison, he has a high risk of getting a serious infection, and the Nevada Department of Corrections does not allow inmates to have cleaning products to sanitize their personal spaces. The district court dismissed King's petition because he was challenging the conditions of confinement and such claims are outside the scope of a postconviction petition for a writ of habeas corpus. We conclude the district court did not err by denying King's petition on this ground. See NRS 34.724(1); Bowen v. Warden, 100 Nev. 489, 490, 686 P.2d 250, 250 (1984). Accordingly, we
ORDER the judgment of the district court AFFIRMED.
