Richard Donta SATTERFIELD, Appellant, v. James DZURENDA, Director; the State of Nevada; NDOC; and Jerry Howell, Warden, Respondents.
ORDER OF AFFIRMANCE
Richard Donta Satterfield appeals from a district court order denying a postconviction petition for a writ of habeas corpus filed on December 20, 2018. Eighth Judicial District Court, Clark County; Tierra Danielle Jones, Judge.
In his petition below, Satterfield argued he was entitled to have his earned statutory credit applied to his minimum term. The district court found that Satterfield is serving two consecutive sentences of life with the possibility of parole after a minimum of 20 years has been served for his conviction of murder with the use of a deadly weapon. The district court concluded that Satterfield is not entitled to have credit applied to his minimum term under NRS 209.4465(7)(b) because he is serving a sentence that requires him to serve a mandatory minimum term before he is eligible for parole. See NRS 200.030(4)(b)(2); 1995 Nev. Stat., ch. 455, § 1, at 1431 (former NRS 193.165). The record supports the district court’s findings and we conclude the district court did not err by denying this claim.
To the extent Satterfield also argued that the Nevada Department of Corrections (NDOC) is not properly applying the statutory credit he has earned to his maximum sentence, the district court found the record demonstrates NDOC has awarded Satterfield with the correct amount of good time credit for every month he has been incarcerated and those credits have been applied to Satterfield’s maximum term. The record supports the district court’s findings and we conclude the district court did not err by denying this claim. Accordingly, we
ORDER the judgment of the district court AFFIRMED.
