ORDER DISMISSING PETITION FOR WRIT OF MANDAMUS AND/OR PROHIBTION
This original petition for a writ of mandamus and/or prohibition challenges a district court order granting partial summary judgment in a trust matter.
On April 8, 2026, petitioner's counsel filed a notice of withdrawal of appeal with this court, indicating that the petitioner consented to a voluntary dismissal of this writ proceeding. Counsel advises this court that he has informed petitioner of the legal consequences of voluntarily withdrawing this writ proceeding. Having been so informed, petitioner consents to a voluntary dismissal of this writ proceeding. We construe petitioner's notice as a motion to voluntarily withdraw his petition. See NRAP 42 (authorizing a petitioner to move to voluntarily dismiss a writ petition, which may be granted if the motion is uncontested).
Having reviewed petitioner's motion and because real parties in interest have not filed any response in opposition, petitioner's unopposed motion for a voluntary dismissal of this writ petition is granted. Accordingly, we
ORDER this petition DISMISSED.
