JAMES HAYES, Appellant, v. G. NAJERA; TATE; D. STEVENS; TOOMBS; J. DZURENDA; K. MCCOY; AND NEVADA DEPARTMENT OF CORRECTIONS, Respondents.
ORDER OF AFFIRMANCE
James Hayes appeals from a district court order dismissing a complaint in a civil rights matter. Eighth Judicial District Court, Clark County; Tierra Danielle Jones, Judge.
Hayes filed the underlying action against respondents pursuant to 42 U.S.C. § 1983 in August 2023. Hayes filed several motions that were rejected or denied by the district court. The district court reviewed the case on January 22, 2025, and ultimately issued a written order dismissing this matter. In its order, the court stated that six months had passed since the last action was taken and the complaint had not been served within 180 days. In light of the foregoing, the district court dismissed the complaint pursuant to EDCR 1.90(b)(2), (d) and EDCR 2.90(a). This appeal followed.
On appeal, Hayes fails to substantively address the grounds on which the district court dismissed his case or argue that the court failed to use the proper procedure in dismissing the complaint based on EDCR 1.90 and EDCR 2.90. Hayes, in his informal brief, only lists the issues raised in his complaint and does not address the district court's bases for dismissing his complaint. Because Hayes fails to present cogent argument as to why he believes the district court erroneously dismissed his complaint pursuant to EDCR 1.90 and EDCR 2.90, he does not demonstrate he is entitled to relief. See Edwards v. Emperor's Garden Rest., 122 Nev. 317, 330 n.38, 130 P.3d 1280, 1288 n.38 (2006) (providing that appellate courts need not consider issues that are not supported by cogent argument). Accordingly, we
ORDER the judgment of the district court AFFIRMED.
