MICHAEL SHANE SAUNDERS, Appellant, v. THE STATE OF NEVADA, Respondent.
ORDER DISMISSING APPEAL
Saunders argues that the district court erred in denying his motion seeking 188 days of credit for pretrial detention. Because no statute or court rule permits an appeal from an order denying a “motion for county jail time,” we lack jurisdiction to consider this appeal.1 See Castillo v. State, 106 Nev. 349, 352, 792 P.2d 1133, 1135 (1990) (“We have consistently held that the right to appeal is statutory; where no statutory authority to appeal is granted, no right to appeal exists.”). Accordingly, we
ORDER this appeal DISMISSED.
Bulla, C.J.
Gibbons, J.
Westbrook, J.
FOOTNOTES
1. We note that Saunders’ motion did not substantially comply with the statutory form for a postconviction petition for a writ of habeas corpus. See NRS 34.73 5; see also NRS 34.724(2)(b) (stating a postconviction habeas petition “[c]omprehends and takes the place of all other common-law, statutory or other remedies which have been available for challenging the validity of the judgment of conviction or sentence, and must be used exclusively in place of them”); Griffin v. State, 122 Nev. 737, 744, 137 P.3d 1165, 1169 (2006) (holding “a claim for presentence credit is a claim challenging the validity of the judgment of conviction and sentence”).
