People of the State of New York, v. Ramal B. Abdullah (2026)

Defendant Ramal B. Abdullah, proceeding pro se, moves pursuant to CPLR 2221(d) for leave to reargue this Court's June 15, 2026, Decision & Order denying, without a hearing, Defendant's motion pursuant to CPL § 440.10(1)(h) to vacate the judgment of conviction. People v Abdullah, 89 Misc 3d 1220(A) (Tompkins Cty Ct 2026). The People oppose the motion.

The Court has considered Defendant's motion and supporting affirmation, dated July 8, 2026, and the People's affirmation in opposition, dated August 13, 2026, together with the record and the Court's prior decisions in this matter.

Following Defendant's conviction after jury trial, Defendant moved pursuant to CPL § 330.30 to set aside the verdict. By Decision & Order dated June 30, 2025, the Court denied that motion and expressly noted that Defendant could pursue any preserved claims on direct appeal. People v Abdullah, 87 Misc 3d 1242(A) (Tompkins Cty Ct 2025). Defendant thereafter moved pursuant to CPL § 440.10(1)(h) to vacate the judgment of conviction. By Decision & Order dated June 15, 2026, the Court denied that motion without a hearing.

Upon consideration of Defendant's present motion for leave to reargue and the People's opposition thereto, Defendant's motion is DENIED. Defendant has failed to demonstrate that the Court overlooked or misapprehended any matter of fact or law in rendering its Decision & Order dated June 15, 2026. Defendant's continued disagreement with the Court's prior rulings is properly addressed through his pending direct appeal, rather than through successive efforts to relitigate those rulings before this Court.

This constitutes the Decision and Order of the Court.
