PEOPLE v. KOPP
Defendant Hernandez's petition for review is granted. The issues to be briefed and argued are limited to the following: Must a court consider a defendant's ability to pay before imposing or executing fines, fees, and assessments? If so, which party bears the burden of proof regarding defendant's inability to pay? Defendant Kopp's petition for review is denied.
