PEOPLE v. SMITH
Dismissed and remanded to CA 2/5. Review in the above-captioned matter, which was granted and held for People v. Strong (2022) 13 Cal.5th 698, 296 Cal.Rptr.3d 686, 514 P.3d 265 and People v. Lewis (2021) 11 Cal.5th 952, 281 Cal.Rptr.3d 521, 491 P.3d 309 is hereby dismissed. (Cal. Rules of Court, rule 8.528(b)(1).) As specified by rule 8.1115(e)(2) of the California Rules of Court, pursuant to this order, the Court of Appeal's opinion, filed May 15, 2020, which appears at 49 Cal.App.5th 85, 262 Cal.Rptr.3d 687, is noncitable and nonprecedential “to the extent it is inconsistent with” our decision in Lewis.
