James WHELAN et al., Appellants, v. Richard PICK et al., Appellants.
The motions of plaintiffs and respondents James Whelan and Gordon Ayars to dismiss review as improvidently granted and to direct issuance of a partial remittitur are granted as to the following claims and parties only: (1) James Whelan's judgment against defendants Pick Systems and Tiger Ventures for breach of contract in the amount of $324,992.42; and (2) Gordon Ayars' judgment against defendants Pick Systems and Tiger Ventures for breach of contract in the amount of $35,000. The Court of Appeal, Fourth Appellate District, Division Three, is directed to issue a partial remittitur consistent with this order. All other claims and parties remain before this court.
LUCAS, C.J., and MOSK, KENNARD, ARABIAN, BAXTER and GEORGE, JJ., concur.
