PEOPLE v. Rafael Vargas ALFARO et al.
ORDER
Because orders sustaining demurrers are not appealable (Pen.Code § 1466, subd. (1); cf. People v. Yoshimura (1976) 62 Cal.App.3d 410, 413, 133 Cal.Rptr. 228) the purported appeal herein is dismissed, without prejudice to the People filing, in cases not yet final, a motion in municipal court for reconsideration of the orders at issue in light of Burg v. Municipal Court (1983) 35 Cal.3d 257, 272–273, 198 Cal.Rptr. 145, 673 P.2d 732.
