The issues to be argued before this court shall be limited to: 1) What standard governs the award of damages for emotional distress resulting from a financial, rather than a personal injury? and 2) Under Civil Code section 3295, subdivision (d) whether a defendant is entitled to a new trial on liability and compensatory damages following the reversal of an award of punitive damages and remand to the trial court for a new trial on punitive damages.
LUCAS, C.J., and MOSK, KENNARD, ARABIAN, BAXTER, GEORGE and WERDEGAR, JJ., concur.
