PEOPLE v. CORTEZ (1996)

Petition for review GRANTED.

The issues to be argued before this court shall be limited to:

(1) Whether there is such a crime as conspiracy to commit second degree murder, premised on express malice aforethought and

(2) Whether the trial court erred by failing to instruct on premeditation and deliberation for the conspiracy to murder charge.
