Pursuant to Rule 29.2, subdivision (b) of the California Rules of Court, the Court specifies the following as the only issue to be argued:
Does Civil Code section 47, subdivision (3) afford a conditional privilege, sometimes referred to as a “public interest privilege,” to a news media report that falsely defames a private individual and, if so, were the news reports at issue in this case subject to the privilege?
LUCAS, C.J., and MOSK, BROUSSARD, PANELLI, ARGUELLES, EAGLESON and KAUFMAN, JJ., concur.
