The cause is transferred to the Court of Appeal, Second Appellate District, Division One, for consideration of whether and to what extent the principles enunciated in Tech-Bilt, Inc. v. Woodward-Clyde & Associates (1985) 38 Cal.3d 488, 213 Cal.Rptr. 256, 698 P.2d 159 may be applicable to an agreement of this type.
Opinion on retransfer, 218 Cal.Rptr. 605.
