STAGEN REALTY AND MANAGEMENT, INC., et al., Petitioners, v. The SUPERIOR COURT OF LOS ANGELES COUNTY, Respondent, PERTUSATI et al., Real Parties in Interest.
This court granted a hearing in this case to determine whether respondent trial court correctly interpreted rule 2-111(A)(4), Rules of Professional Conduct, in ordering the disqualification of petitioner's counsel from a case pending before it. Rule 2-111(A)(4) was substantially amended effective November 1, 1979. The question of the correctness of the respondent court's interpretation of the former rule is therefore now moot. Accordingly, the alternative writ heretofore issued is discharged and the proceeding is dismissed without prejudice to the right of petitioner to move in respondent court on or after November 1, 1979 under the amended rule to set aside the order of disqualification heretofore issued. This order is final forthwith.
