Pursuant to the stipulation on file herein among the parties to the appeal in the above entitled cause the order construing will and for partial distribution appealed from is hereby modified in accordance with said stipulation and as so modified said order is affirmed without costs. Upon the going down of the remittitur the trial court is directed to enter the order as so modified. Also pursuant to said stipulation the remittitur shall issue forthwith.
