The petition for a hearing is denied. In denying a hearing, however, we think that the judgment should be affirmed under the provisions of article 6, § 4 1/2, of the Constitution, and we withhold approval of that portion of the opinion of the District Court of Appeal which deals with the admissibility of the contract provision and the propriety of the instruction of the trial court thereon.
