PEOPLE v. RODRIGUEZ
Dismissed and remanded to CA 4/1. Review in the above-captioned matter, which was granted and held for People v. Braden (2023) 14 Cal.5th 791, 308 Cal.Rptr.3d 846, 529 P.3d 1116, is hereby dismissed. (Cal. Rules of Court, rule 8.528(b)(1).) As specified by rule 8.1115(e)(2) of the California Rules of Court, pursuant to this order the Court of Appeal's opinion, filed September 2, 2021, which appears at 68 Cal.App.5th 584, 283 Cal.Rptr.3d 501, is non-citable and nonprecedential “to the extent it is inconsistent with” our decision in Braden.
Guerrero, C.J., was recused and did not participate. Votes: Liu, A.C.J., Corrigan, Kruger, Groban, Jenkins and Evans, JJ.
