Appellants above named having filed in this court a ‘Notice of Motion for Diminution of Record,’ and an amendment thereto, together with an affidavit of appellants' attorney in support of said notice of motion, which said motion is for an order of this court incorporating in the record on appeal on file herein a certified copy of Proposed Findings of Fact, Notice of Presentation of Findings, and proposed Judgment, all of which are on file in the trial court; and said motion having come on for hearing on September 6, 1951, and it appearing that the records which appellants seek to have incorporated in the record on appeal may be germane to the matters involved in said appeal, it is ordered that certified copies of said Proposed Findings of Fact, Notice of Presentation of Findings, and proposed Judgment be transmitted to this court by the clerk of the Superior Court of the County of Shasta, but solely at the cost of said appellants.
