IN RE: THE ESTATE OF VIOLA G. SANDERS, DECEASED. EDITH SANDERS STEWARD, BENJAMIN SANDERS, AND HELEN SANDERS BOEHNER, RESPONDENTS, v. MINNIE MAUDE STODDARD, APPELLANT.
On stipulation of all parties to this appeal, duly filed herein, it is hereby ordered that the Decree Determining Heirship, dated November 8, 1943, from which this appeal was taken, is hereby modified by striking therefrom the second paragraph, reading as follows:
“It is ordered, adjudged and decreed that Minnie Maude Stoddard, sister of the above named decedent, be and she is entitled to distribution from the said estate of Certificate No. 48 evidencing seven shares of stock of Sheldon University Press standing in the name of V. G. Miller which was the maiden name of the above named decedent; the said Minnie Maude Stoddard is further entitled to distribution from said estate of old coins in the sum of $64.00 and in addition thereto of the sum of $768.04; that the brother and sisters of Leslie L. Sanders, predeceased husband of the above named decedent, said brother and sisters being named as follows, to–wit: Ben E. Sanders, Edith Sanders Steward and Helen Sanders Boehner, are entitled to distribution of all of the rest, residue and remainder of said estate.”
And inserting in lieu thereof the following:
“It is ordered, adjudged and decreed that Minnie Maude Stoddard, sister of the above named decedent, is entitled to have distributed to her one–half of the estate of Viola Glen Sanders, deceased, and that Benjamin Sanders (sometimes called Ben E. Sanders), Edith Sanders Steward and Helen Sanders Boehner, are entitled to distribution of all of the rest, residue and remainder of said estate.”
As so modified the decree appealed from is affirmed. Each party to pay his own costs on appeal, and, by stipulation, the remittitur shall issue forthwith.
