State), [Ms. 1150559, September 16, 2016] ___ So. 3d ___ (Ala. 2016). On remand to this court, and in compliance with the supreme court's opinion of September 16, 2016, the summary judgment entered in favor of the State of Alabama by the Madison Circuit Court is hereby affirmed.

AFFIRMED.
